Can't delete folder

I have this empty Downloads folder which I can't delete. I don't really know why I would want to, but I can't.
Everytime I try it says the file is already in use. I've tried changing the download dir of every program I use to another folder, but it's still "in use".
Is there a way to track down which program use the folder, or is there perhaps another way of getting rid of it? I guess some sort of spyware/virus is in action. I've scanned the folder several times with no results.

ehmmm let me think...
1. Start -> Run -> type cmd and press enter(the command box will open)
2. find out where the map 'Downloads' is located... you need to know which directory then type 'dir directory name and cmd will show a list of folders there are in that directory... find out the exact name and do... DEL folder name + extension

Otherwise press F8 during startup and select 'secure mode'(?)
then u can delete it..
